- for the lone function of carrying out the transmission of a communication over an electronic communications network, or
- where such storage or access is absolutely essential for the provision of an information society service requested by the subscriber/user.
To put it more succinctly, this amendment states that a website which uses cookies must alert the user that the site he or she is visiting is using cookies technology to gather and store their personal information and preferences. This alert must be stated clearly, and the user must give consent for the website to use cookies. The ruling also states that users must understand and agree that their data will be collected and stored, and they shall have access to this collected and stored information at their request.
